At least 80 percent of the women would try to look down at the end of the table, wondering if they cold see anything which is why our doctor always went in with the scalpel first. Once the baby was already cut up, there was nothing but blood and torn up tissue for the woman to see. When a later abortion was performed, workers had to piece the baby back together, and every major part--head, torso, two legs, and two arms --had to be accounted for. To begin, I must say that until yesterday, Friday, July 2, 2004, I was strongly pro-choice. I am a pre-medical student, and being very scientific, I understood that the mass of cells that forms the fetal body is not often capable of survival before 24 weeks in the womb. I am also somewhat liberal, and I believed that every woman should have the right to choose what she did with her body and one that could potentially be growing inside of her. This summer, I was accepted into a pre-medicalprogram in NYC in which we are allowed to shadow doctors and see all sorts of medical procedures. When given the opportunity to see an abortion, I did not hesitate to accept the offer. It was something new, edgy, and exciting that I had never seen. When I entered the operating room, it felt like any other I had ever been in. On the table in front of me, I saw a woman, legs up as if delivering a child although she was asleep. Next to her was a tray of instruments for the abortion and a vacuum machine for suctioning the fetal tissues from the uterus. The doctors put on their gowns and masks and the procedure began. The cervix was held open with a crude metal instrument and a large transparent tube was stuck inside of the woman. Within a matter of seconds, the machine's motor was engaged and blood, tissue, and tiny organs were pulled out of their environment into a filter. A minute later, the vacuum choked to a halt. The tube was removed, and stuck to the end was a small body and a head attached haphazardly to it, what was formed of the neck snapped. The ribs had formed with a thin skin covering them, the eyes had formed, and the inner organs had begun to fuction. The tiny heart of the fetus, obviously a little boy, had just stopped -- forever. The
vacuum filter was opened, and the tiny arms and legs that had been torn off of the fetus were accounted for. The fingers and toes had the beginnings of their nails on them. The doctors, proud of their work, reassembled the body to show me. Tears welled up in my eyes as they removed the baby boy from the table and shoved his body into a container for disposal. I have not been able to think of anything since yesterday at 10:30 besides what that baby boy might have been. I don't think that people realize what an abortion actually is until they see it happen. I have been tortured by these images - so real and so vivid - for two days now...and I was just a spectator. Never again will I be pro-choice, and never again will I support the murder of any human being, no matter their stage in life.

(See February 2005 magazine in their article, "Abortion Options.") Yet, in another Consumer Reports Magazine article about the safety of baby seats, babies are referred to as "precious cargo." ProLife Ministries would like to know when and how Consumer Reports Magazine makes their determination and decision that some babies are "uterine content," while other babies are "precious cargo." Could this be that Consumer Reports Magazine uses the same decision-making process that Adolph Hitler did when he decided who was to live and who was to die???

“Nellie, thank you. Thanks a lot for inviting me to speak. I know it's chilly there in Washington, but weather hasn't stopped
thousands of participants from marching for life for the past 32 years, and it did not this year, either. And so I'm honored to be a part of this
tremendous witness that is taking place in our Nation's Capitol, and it's good to hear your voice again.

Our country is very blessed indeed, to
have George W. Bush serve us as our President. President Bush is an honest
Christian who loves and serves not only the citizens of our country, but also,
and most importantly, our Lord and Saviour. President Bush does not make
it a secret, or hide the light, that lights his soul. He is an outspoken
believer in Jesus.
President Bush's candor about, and willingness to share his faith has been
remarkable:
– The morning after officially becoming President-elect, the very first thing
Bush did in public was to attend a prayer meeting at a church in Austin were he
sought God's blessing and guidance.
– In his speech launching his Presidential campaign, Bush said, "I
believe in grace because I've seen it, and peace because I've felt it, and
forgiveness because I've needed it." He regards himself as a "lowly
sinner" who is saved by God's grace, a concept that has humbled him.
– Bush says he prays every day in all kinds of situations, and has been seen
to quietly bow his head and pray before news conferences and important meetings.
"I pray for guidance. I do not pray for earthly things but for heavenly
things, for wisdom and patience and understanding."
– Bush reads through the entire Bible every other year; he chooses relevant
Scriptures during the alternate years for his daily devotions. This was also
undoubtedly helpful during the years he taught Sunday School.
– Asked in a debate what "philosopher" he admires most, he
responded, "Christ, because He has changed my heart." (He took much
flak for saying that.) He continued, "When you turn your heart and your
life over to Christ, when you accept Christ as Savior, it changes the heart and
changes your life, and that's what happened to me."
– Bush's autobiography, "A Charge To Keep," takes its title
from a Charles Wesley hymn, "A charge to keep I have, A God to
glorify..." Those last four words go unspoken, but are apparently very much
a part of Bush's philosophy, and, for those who make the connection, are
enlightening.
– As governor of Texas, Bush sent a memo reminding his staff that "we
serve One greater than ourselves."
Will his beliefs affect what he does in office? Bush's brother, Gov. Jeb
Bush of Florida, says there is no question about that. He says his brother will
"inspire people to act on their faith, not just to focus on one's
salvation, but to define our activities and our faith in a way that will help
others." It's all about "walking the talk."
Even President Bush's closest associates say the faith he
professes genuine, not something merely "worn on his sleeve" for
attempted political gain.
President Bush will, no doubt, continue to be attacked for his Christian
faith. He will be under the harshest fire and most stinging condemnation
you have ever seen from those who don't share his faith. He will be vilified by
the humanist, 'extremist,' liberal left. Just look what the opposition is doing
to attorney general nominee John Ashcroft, who has been active in leadership
roles in the Assemblies of God church and, by the way, a lover of Southern
Gospel music. In fact, look at the agony President Bush himself went through for
those 30-some days after the election when the outcome seemed in doubt. Surely
only his faith could have sustained him through such a trying time. And
undoubtedly his faith was strengthened by “going through the fire.”
Please Pray for President Bush!
Pray daily and fervently for our new President. Why? Well, the simple answer is
because the Bible tells us to pray for our leaders, but also;
— PRAY because "the effectual
fervent prayer of a righteous man availeth much. James 5:16
— PRAY because President Bush will continue to be the target of
a merciless attack by those incensed by his Christian values.
— PRAY for President Bush's protection and physical safety and for his family.
— PRAY that his strength may be renewed daily through his faith and trust in
Jesus, our Lord and Saviour.
— PRAY that God will grant President Bush "Solomon-like" wisdom in
leading and healing this nation and encouragement to stay the course.
— PRAY that God will provide our President with godly counselors and
associates.
— PRAY that those who are incensed by his faith-based stands will be thwarted

Deadly pro-abortion violence has been reported at least since 1965,
and is escalating rapidly, with 142 homicides committed in
just the last decade (since 1995). 1999 was the bloodiest year, with
pro-abortionists murdering 31 people, including 12 pregnant women, two
other women, four of their girlfriend's children, and 13 preborn
children. Both 2002 and 2003 were close behind, with 28 pro-abortion
killings each. In fact, pro-abortionists have averaged more
murders per year since 1980 (that's 24 years in a row) than so-called
`pro-lifers' have in the history of the entire conflict over
abortion..[41]
Deadly "pro-life" violence only began when the pro-abortion
movement started to choke off peaceful means of protest through
Congress and the courts (Michael Griffin committed the first murder by
a "pro-lifer" in March 1993, just a couple of weeks after
Congress began to selectively crack down on peaceful protest with the
Freedom of Access to Clinic Entrances (FACE) Bill.
"Pro-life" violence is almost always directed at the
burning and destruction of abortion mills. In fact, clinic bombers
have explicitly testified that they carried out their activities in
the middle of the night to avoid hurting anyone. As shown in the
comparison above, the vast majority of pro-abortion violence is
directed against human beings. This is logical. If a movement can
advocate the killing of millions of inconvenient or unwanted preborn
people, its members will naturally extend this killing to born people.
As the state-by-state documentation list shows, many instances of
pro-abortion assault are extremely cowardly. Pro-abortion men prefer
to kick, punch, slap and spit on small children, women and elderly
adults. They only attack young adult pro-lifers when they are in mobs.
Pro-abortionists always like their victims -- born or preborn -- to be
helpless.
"Demand of anti-choice leaders that they condemn the murders of
reproductive health care providers and disavow those who advocate and
justify violence, bombing, stalking, and murder. Let them know their
statements must be clear and unequivocal."[42]

Violence
the World Over. Vivian Robinson, a General Medical Council representative, said
that Gbinigie botched three abortions on his very first day at his
private abortion mill, leaving parts of preborn babies inside three
women.
Also on his first day, the abortionist grossly botched a 20-week
abortion in November 2000, rupturing the patient's uterus wall and
removing her right ovary and fallopian tube. It was only after he
pulled out a piece of her bowel that he realized something was
wrong. The woman's life was saved only after three consultants
carried out a five-hour emergency operation during which her right
kidney had to be removed. One of the emergency surgeons described
the woman's insides as "just a mess ... A rush of blood
carrying the partially dismembered fetus just went everywhere, all
over the place ... The fetus was largely intact, apart from one arm
and one leg." When her stomach was opened, said another
witness, the "cavity was full of blood and floating on top was
a 20-week-old fetus, largely intact apart from a missing arm and a
missing leg."
Gbinigie told Tina Palmer that her preborn child was grossly
malformed, and offered to perform an abortion on her. But she
refused to abort, and gave birth to a healthy little girl, Naomi.
She said if she and her husband Brendan had taken Gbinigie's advice
they would not have their "lovely girl."
Nicola Evans had a child after being "sterilized" by
Gbinigie, has organized a support group for women butchered or
injured by him. She said: "The amount of phone calls from women
who phoned up upset, crying over the phone, it's just absolutely
amazing. We've got 25 names from the West Midlands."
The Brits are just as
conscientious about protecting their many incompetent abortionists as
the Americans and Canadians are. Gbinigie is still on the medical
register. He was found guilty of serious professional misconduct by the
General Medical Council (GMC), but escaped a ban from practicing
medicine. In fact, after setting what might be an abortionist's world
record for four botched abortions in one day, he was back committing
abortions within two weeks.[73] |

relationship. Every state has statutory rape laws that prohibit sex

that were designed to protect children from sexual abuse. And we now

Court Rules Fetus Is a
Person

The Arkansas Supreme Court
has ruled that a fetus is a person, reversing a lower court's ruling in a
wrongful death suit brought by a man whose wife and unborn baby died during
birth.
The state Supreme Court cited Thursday a
1999 law that changed
Philip Aka claimed the defendants were
medically negligent in unnecessarily inducing labor in his wife, Evangeline,
failing to discontinue the procedure, failing to perform a caesarean section,
failing to resuscitate his wife or the unborn child, and failing to obtain
informed consent.
A circuit judge ruled against Aka, citing a
Supreme Court ruling that a fetus is not a person in wrongful-death cases. The
same year of the ruling, the legislature approved a law stating that an unborn
fetus could be considered a person for some purposes in criminal law.

it is neither the mother nor the father."

JACKSON,
Miss. — The Mississippi Supreme Court, in a decision criticized by one of its
members as an assault on Roe v. Wade (search), held Thursday that a fetus is a
"person" under state law and wrongful death claims can be filed on its
behalf.
The
justices upheld Tracy Tucker's right to pursue a wrongful death claim (search)
after she alleged emotional distress and a mistake by her doctors caused her to
have a miscarriage (search) in 1997. The fetus was 19 weeks old at the time,
according to doctors.
Attorneys
for the defendants couldn't be reached or declined comment.
Presiding
Justice Chuck McRae, in a written dissent, described the decision as an assault
on Roe v. Wade, the landmark ruling that legalized abortion in America.
The
6-2 ruling expands the definition of a "person" in wrongful death
statutes to include an "unborn child."

law allows people to sue for the wrongful death of a newly born, or prematurely
born, fetus that would have been expected to live.

Justice Jim Smith, writing for the court, said Thursday's ruling in the lawsuit
brought by Tucker had nothing to do with abortion. He said doctors performing
abortions are still protected by
"Tucker's
interest is to protect and preserve the life of her unborn child, not in the
exercise of her right to terminate that life which has been declared
constitutional by the U.S. Supreme Court," Smith wrote.
Pat
Cartrette, executive director of Right to Life of Jackson, said while the
decision may not directly affect Roe vs. Wade, it gives a fetus some legal
protection when it develops reflexes, at some cases as early as 8 weeks.
Sondra
Goldschein, state strategies attorney for the American Civil Liberties Union
said she was troubled by the court's definition of a fetus as a
"person."
"Anytime
the fetus is recognizable as a person it chips away at the foundation of
Roe," she said.
"The
embryo is a new human life which is genetically distinct
and which has energy and a direction of its own
from the moment of conception."

beautiful words could never be written. Human life is not just another animal.
Evolution is the world’s biggest lie! God has a plan for His human family, and
no living soul is exempt. Every part of our physical body was designed by the
Creator. He did not simply create Adam and Eve and leave it all to the process
of addition. Each living soul is uniquely designed and individually planned. Any
other possibility defies common sense.
Jesus
Christ was conceived by the Holy Ghost in Mary’s womb and in that instant
Jesus’ presence, in Mary’s womb, affected
Mary and others. Elizabeth and her son, six-months after conception, were filled
with the Holy Ghost by the presence of Mary and her womb-borne “Savior and
Deliverer.” This kind of activity in the wombs of these mothers testifies to
the glory of an unborn child! That God would choose to send His ONLY Son to
redeem mankind by using His creative ingeniousness of a Mother’s womb, forever
proves life begins at conception. Jesus Christ is eternal and there was no
nine-month lapse in His conscious existence. He did not “come down” from
heaven when He was born. He came down when He was conceived by the Holy Ghost in
Mary’s womb.
The
blood of every murdered baby is crying from the earth! Can you hear these moans
of sorrow? The Heavenly Father can.
When
Cain killed Abel, the Father cried to this first murderer, “Where is Abel thy
brother?” Cain answered back with a lie and an excuse, “I
know not: Am I my brother's keeper?” Then God spoke awesome words, “And he
said, What hast thou done? the voice of thy brother's blood crieth unto me from
the ground.” (Genesis 4:9-10)
The
Judgments of God are gathering like a “pinned-up storm”, soon to be
unleashed. Blood, innocent blood of the multitude of “little ones” never
allowed to see the light of day, are crying and God is listening.
All that God asks of
us is to weep in repentance and to stand up in defense that we may end this
sacrifice of our babies. Jeremiah said “crying and sighing” was our duty in
the face of every abomination of sin. If we will both “weep in repentance”
and “stand in defense”, our God will continue to raise up “pastors and
political leaders” that will put their careers on the line for the unborn.
“Roe versus Wade” has a death warrant that is being signed by the praying
people of
True love between a man and woman leads to marriage. It is natural for a man and woman to be together. This is recorded in Genesis, the first book of the Old Testament, when God blessed man and woman and called them to be “fruitful and multiply.”
And
God created man to his own image,
to the image of God he created him.
Male and female he created them.
And God blessed them, saying, Increase and multiply.

The natural
law puts man and woman together for mutual comfort and for the procreation of
the human race. Life and Love come from God our Creator [see our page on Christian
Bioethics for further discussion]. Marriage is the institution of our
Creator and blessed in the ceremony of our Churches to realize in man His design
for love. All religions have always protected the sanctity of marriage and the
family.
Children are the fruit and the bond of a marriage!

Individual life
begins with conception by the union of the couple's sex cells or gametes.
The 23 chromosomes of the paternal sperm (male pronucleus) fuses with the 23
chromosomes of the maternal oocyte (egg or female pronucleus) at fertilization
to create a single cell embryo or zygote containing 46 chromosomes. The
fertilization process takes about 24 hours.
The new human zygote has the inherent capacity or potential to become a fully
rational and cognizant person!
The Pre-embryonic Period extends from the
moment of fertilization of the ovum to the 4th week after conception. During
this phase, the zygote undergoes continual cell division, implants in the
uterus, and forms the primary germ layers, which give rise to the organs of the
human body.
The
zygote
begins dividing about every 12-20 hours , first into 2 cells called blastomeres.
The blastomeres divide repeatedly without growth and thus decrease in size. By
three days division into 16 cells has taken place, and the zygote assumes the
shape of a mulberry, becoming known as a 16 cell morula. The morula then
leaves the fallopian tube and enters the uterine cavity three to four days after
fertilization. Cell division continues, and a cavity known as a blastocele forms
in the center of the morula. With the appearance of the cavity in the center,
the entire structure is now called a blastocyst.
The presence of the blastocyst indicates that two cell types are forming: the
embryoblast (inner cell mass on the inside of the blastocele), and the
trophoblast (the cells on the outside of the blastocele). The inner cell mass
becomes the embryo, and the trophoblast becomes the placenta. The
blastocyst implants into the endometrial lining of the uterus via its
trophoblast from the 7th to 10th day after fertilization. he
pre-embryonic period includes the formation of the three primary germ layers,
the ectoderm, mesoderm, and endoderm, from which come the organs of the human
body.
The Embryonic Period is characterized by
dramatic cell differentiation from the fourth through the eighth week, so that
the beginnings of all essential structures of the human body are present.
A fully recognizable human embryo is complete after the eighth week!
The human embryo now measures just over one inch long and weighs about 4.5
grams.
The Fetal Period lasts from the ninth week
to the 38th week after conception, and is characterized by rapid growth. Viability
is the time when the fetus can live outside of the womb, independently of the
mother. Prematurity is defined when an infant is born before 37 weeks of
gestational age. With modern neonatal units, extremely premature babies may
survive at 23-25 weeks gestation (21-23 weeks embryonic growth), although there
is a high risk of permanent handicap. The decision to resuscitate or offer
comfort care for the extremely premature infant is a complex one: the goal to
care should be one that will increase survival and decrease the prevalence of
disability among survivors.11
As physicians do not know when fertilization
occurs, we measure the term of the baby from the first day of the last menstrual
period, which is approximately two weeks prior to fertilization, and this is
known as the Gestational Age. Thus while the human takes 38 weeks (266
days) to develop in the womb prior to birth, the Gestational Age is given as 40
weeks (280 days) or 10 lunar months (each lunar month being 28 days), or roughly
9 calendar months and 7 days. This time is divided into the three trimesters of
pregnancy, lasting 3 months each. The expected Due Date for delivery, or EDC
(Estimated Date of Confinement), is calculated by adding 7 days to the first day
of the last menstrual period and then subtracting 3 months. For example, if the
pregnant patient's first day of her last menstrual period was February 1, then
her due date is November 8.
Physicians have three primary means of detecting pregnancy - the physical
examination of the mother, the pregnancy test, and the ultrasound.
The trophoblast after implantation begins secreting the protein HCG,
human chorionic gonadotropin. All pregnancy tests - home urine and hospital
serum pregnancy tests - detect this protein at varying degrees of sensitivity.
Since implantation occurs 7-10 days after conception, a serum pregnancy test may
detect pregnancy as early as 7-10 days after conception, and almost certainly
within two weeks of conception, or 4 weeks of gestational age. Once implantation
occurs, human chorionic gonadotropin doubles every 1.4 to 2.0 days.
The ultrasound has become a most valuable tool in assessing life in the womb.
The earliest definitive finding on ultrasound is the gestational sac, which may
be detected from 4-6 weeks of gestation. The heartbeat may be detected on ultrasound as early as
6 weeks of
gestation! The baby's heartbeat may be heard with a stethoscope by 16 to 19
weeks of gestation. The normal fetal heart rate ranges from 120 to 160 beats per
minute.
A fully-formed baby can readily be seen on ultrasound by the first trimester
of pregnancy.
NORMAL LABOR AND DELIVERY
Parturition
is the birth process of the baby. Labor begins with involuntary uterine
contractions that first result in effacement and dilation of the cervix, and
then, in conjunction with voluntary bearing-down of the mother, the progress of
the baby down the birth canal. Crowning is the presentation of the baby's
head at the introitus or vaginal opening. Delivery occurs with the
complete birth of the baby!
Five essential factors influence the process of labor: the baby or the
passenger, the size of the birth canal, or "passageway," the
"power" or strength, frequency, and duration of uterine contractions,
the position of the placenta, and the psychologic state of the mother.

Vertex and Breech Presentations
The ideal
situation is for the baby to be in a longitudinal or vertical lie and to
present head first in the birth canal, or vertex presentation. Delivery
may be difficult if the baby is in a vertical lie but a breech
presentation. Breech presentations are called frank when the pelvic
sacrum enters first, complete when the pelvis and both feet enter, and footling
when one foot enters the birth canal. Delivery is impossible if the baby is in transverse
lie, and this generally leads the obstetrician to surgically remove the baby
by Caesarean Section.
There are three traditional stages to
labor
The first stage occurs from the beginning of uterine contractions to the
complete dilatation of the cervix. The beginning of labor often coincides with
"show," the discharge of the mucus plug of the cervix, and the
"water breaking," the release of amniotic fluid with the rupture of
the amniotic sac. Effacement of the cervix means the thinning of the cervix, and
dilatation refers to the widening of the cervical diameter from 1 cm to 10 cm,
to allow for the progress of the baby down the birth canal.
The second stage lasts from full dilatation of the cervix with transition
down the birth canal, to the actual delivery of the baby. Progress in the
descent of the presenting part (usually the head) is determined by vaginal
examination until crowning occurs. The location of the head in relation to the
ischial spines is designated the station, and is a mean of determining
the progress of the baby down the birth canal. The level of the ischial spines
is considered to be station 0, and the position of the head is described in
centimeters minus (-1 to -5) above the spines or plus (+1 to +5) below the
spines.

Delivery of the Baby
Once crowning (A)
occurs, gentle delivery of the head (B) follows. Gentle downward traction brings
descent and then delivery of the anterior shoulder (C). Subsequent gentle upward
traction allows delivery of the posterior shoulder (D). The rest of the body
easily follows once the shoulders are delivered, and the newborn is here!
The baby enters the world!
The third stage occurs from the delivery of the baby to the delivery of
the placenta.
IMMEDIATE CARE OF THE NEWBORN
The
newborn must receive immediate care upon delivery. The delivery team must first
ensure a clear airway. A bulb syringe is used to suction the mouth to prevent
aspiration. Then the nares (nose) is aspirated. Suctioning of the nares
stimulates the neonate to take a breath.
The umbilical cord is clamped about 30 seconds after delivery when cord
pulsations cease. The cord is examined for the normal presence of two arteries
and one vein.
The newborn must be kept warm, generally by placing a blanket around the baby's
head and body, and then placing the baby on the mother's abdomen.
The condition of the baby is assessed at one minute and 5 minutes, generally by
using the APGAR Score. The APGAR Score assesses the baby's heartbeat by
auscultation with the stethoscope; respirations by observance of chest wall
movements; muscle tone, based on movement of the extremities; reflex
irritability, the response of the baby to suctioning; and color, whether blue or
pale, body pink with cyanotic feet, or all pink. The one-minute score is
variable, but a score of 7 or greater is generally indicative of a healthy baby,
and the ideal five-minute score is 10.

Hippocrates was a Greek physician, who
lived from 460 to 377 B.C. He was referred to in ancient times as
"Hippocrates the Great." Aristotle in his Politics referred to him as
"The Great Physician." Until recently he was known as "The Father
of Modern Medicine." The reason this man was so revered in medical circles
is that the Oath, which bears his name, was the foundation of medical morals and
ethics for more than two thousand years. And, although Hippocrates himself may
not have actually formulated it, until very recent times it was an honored
custom for every doctor to take this oath - and keep it!
The Oath is rather long and involved, so I
shall give just the salient points: "I will give no deadly medicine to
anyone if asked or to suggest any such counsel. Furthermore, I will not give to
a woman a pessary to produce an abortion."
In 1948, this Oath was repeated, in
essence, and its values enshrined in the "Declaration of Geneva," by
the World Medical Association. The Declaration says, in part, "I will
maintain the utmost respect for human life from the time of conception. Even
under threat, I will not use my medical knowledge contrary to the laws of
humanity. I make these promises solemnly, freely and upon my honour."
So even by pagan standards, the raison
d'etre of the doctor's vocation was, from the very beginning, to care and
cure but never to kill. It is a sad commentary on the present state of medical
morals that it can be statistically proven that the most dangerous place to be
today is in a mother's womb!

Kenneth C. Edelin is found guilty of manslaughter for the death of an unborn

The first Human Life Amendment is introduced in the U.S. Senate by Sens. James
L. Buckley (Cons.-NY) and Jesse Helms (R-NC).

In a 4-3 split decision, the state high court upheld the right of an unmarried father to sue for the auto-accident death of his unborn fetus.
Jason O'Connor's unborn child was killed in a car accident in August 1990, according to the decision. The woman carrying the fetus, Vicki Richards, also was killed when the car she was riding in was hit by a tractor trailer. She was about four months pregnant.
O'Connor sought damages from the death for his unborn child under a state law that allows a civil damage suit for the death of a relative.
In its decision, the Missouri Supreme Court held that O'Connor could file suit for damages under the state's wrongful death law.
The court based its decision on state law that says that life begins at the moment of conception.
The majority opinion that law represents a clear decision by the state legislature that all laws should consider a fetus, even if non-viable, as a legal "person."
"We must be more sensitive to legislative direction and less sensitive to our own evaluation of policy considerations," the court wrote.
The statute, court wrote, "does set out a cannon of interpretation enacted by the general assembly directing that the time of conception and not viability is the determinative point at which the legally protectable rights, privileges, and immunities of an unborn child should be deemed to arise."
Neither the majority opinion nor the dissenting opinion of Chief Justice Ann Covington made any reference to abortion nor to U.S. Supreme Court decisions that have prevented government from prohibiting a woman from obtaining an abortion of her non-viable fetus.
Both anti-abortion and abortion-rights advocates say the court's decision does not involve abortion.
"It has nothing to do with abortion," said Crystal Williams, the lobbyist for Planned Parenthood, a family planning clinic and abortion provider.
Samuel Lee, pro-life lobbyist, said the decision will not have a direct effect on the abortion debate, but may impact the future.
"This decision shows how schizophrenic the law is," he said.

The year was 1969 ... Law and politics
had not yet "altered medical science."*
The terminology of medical texts had not yet been changed to depersonalize
life in the womb. (The pregnant woman was "the mother" and the fetus
was "the child" or "baby.") McGraw-Hill Inc. was publishing
a book on Conception, Birth and Contraception and needed some input from
an authority on the subject. It turned to Planned Parenthood and the Sex
Information & Education Council of the
"This book provides a solid base for understanding the anatomy of reproduction," wrote Mary S. Calderone, MD, Executive Director of SIECUS, in her Introduction to the 129-page book. "Access to such fine books as this one will assure our young people that ... finally adults are becoming willing to 'tell it like it is.'"
Similarly, "Dr. George Langmyhr of Planned Parenthood Federation of America ... reviewed the material on contraception," state authors Robert J. Demarest and John J. Sciarra, MD, PhD, in their Foreword.
Within the pages of Conception, Birth and Contraception, however, the pro-life position is presented with pictorial and verbal accuracy. The book clearly pushes contraceptives, with some faulty information on the safety of the IUD, etc., but the personhood of the unborn is fully supported throughout the text.
In fact, the book's own glossary definition of the term "fetus" begins with: "An unborn child." Pregnancy, likewise, is defined as: "The condition of being with child."
In the aftermath of Roe v. Wade, of course, today's Planned Parenthood -- largest abortion provider in the world -- would never admit that life begins at conception, or depict the infant in utero, in full-page illustrations, as a person. To do so, would suggest not only a violation of rights, but even murder, in the diabolical Roe v. Wade decision.
No doubt today's SIECUS, as well, would attempt to discredit the pro-life (factual) content of this "fine book" which it's leader in 1969 described so positively.

"Each of us has a very precise starting moment which is the time at which the whole necessary and sufficient genetic information is gathered inside one cell, the fertilized egg, and this is the moment of fertilization. There is not the slightest doubt about that and we know that this information is written on a kind of ribbon which we call the DNA."
Jérome Lejeune, M.D., Ph.D., tells us much about the intricacies of the beginning of human life. Contrary to the popular view that the tiny baby becomes more and more "developed" as the weeks of pregnancy go on, Dr. Lejeune says that the very first cell, the fertilized egg, is "the most specialized cell under the sun." No other cell will ever again have the same instructions in the life of the individual being created.
In the words of Dr. Lejeune, "Each of us has a very precise starting moment which is the time at which the whole necessary and sufficient genetic information is gathered inside one cell, the fertilized egg, and this is the moment of fertilization. There is not the slightest doubt about that and we know that this information is written on a kind of ribbon which we call the DNA."
He explains that the fertilized egg contains more information about the new individual than can be stored in five sets (not volumes) of the Encyclopedia Britannica (if enlarged to normal print). To further emphasize the minuteness of this language, Dr. Lejeune states that if all the one-metre-long DNA of the sperms and all the one-metre-long of the ova which contain the instructions for the 5 billion human beings who will replace us on this planet were brought together in one place the total amount of matter would be roughly the size of two aspirin tablets.
When Dr. Lejeune testified in the Louisiana Legislature (House Committee on the Administration of Criminal Justice, June 7, 1990) he stated, "Recent discoveries by Dr. Alec Jeffreys of England demonstrate that this information (on the DNA molecule) is stored by a system of bar codes not unlike those found on products at the supermarket... it's not any longer a theory that each of us is unique."
Dr. Lejeune states that because of studies published within the last year we can now determine within three to seven days after fertilization if the new human being is a boy or a girl.
"I see no difference between the early person that you were at conception and the late person which you are now. You were, and are, a human being."
"At no time," Dr. Lejeune says, "is the human being a blob of protoplasm. As far as your nature is concerned, I see no difference between the early person that you were at conception and the late person which you are now. You were, and are, a human being."
In the testimony Dr. Lejeune gave on the Seven Human Embryos (Circuit Court for Blount County, Tennessee at Maryville, Equity Division, August 8-10, 1989) he compared the chromosome to a mini-cassette, in which a symphony is written, the symphony of life. He explained that if you buy a cartridge on which a Mozart symphony has been recorded and insert it in a player, what is being reproduced is the movement of the air that transmits to you the genius of Mozart. In making the analogy he said, "It's exactly the same way that life is played. On the tiny mini-cassettes which are our chromosomes are written various parts of the opus which is for human symphony, and as soon as all the information necessary and sufficient to spell the whole symphony (is brought together), this symphony plays itself, that is, a new man is beginning his career ... as soon as he has been conceived, a man is a man."

Lejeune died on April 3, 1994. Dr. Lejeune of Paris, France was a medical
doctor, a Doctor of Science and a professor of Fundamental Genetics for over
twenty years. Dr. Lejeune discovered the genetic cause of Down Syndrome,
receiving the Kennedy Prize for the discovery and, in addition, received the
Memorial Allen Award Medal, the world's highest award for work in the field of

Most doctors and lawmakers recognize cloning as a technological breakthrough
that adds a new dimension to reproductive technology. Few realize that cloning
also proves that life begins at conception!
Cloning technology is simple to understand. All cells containing DNA have 46
chromosomes except the sperm and egg, which have only 23 chromosomes each. In
natural conception, 23 chromosomes of the sperm and 23 chromosomes of the egg
unite to create a single cell embryo containing 46 chromosomes. The genetic
makeup of every living human being is determined when the sperm and egg unite.
This is commonly known as the point of conception.
Conversely, in cloning, one adult cell containing 46 chromosomes is isolated
from a donor. The DNA or genetic material comprising 46 chromosomes is removed
from the donor cell. Similarly, a recipient egg is selected, isolated and the 23
chromosomes of a recipient egg are removed and discarded. The 46 chromosomes of
the donor cell are introduced into the now empty (enucleated) egg. This is the
point of conception! Therefore, the moment the 46 chromosomes of the donor cell
are introduced into the enucleated egg, a single cell embryological twin of the
donor has been created.
This twin cannot become anything but a genetic duplicate of the donor. It is set
on a predetermined pathway of life. It cannot have different eye color. It
cannot have different hair color. It is a carbon copy in every physiological
respect.
